Oakhaven Collective, LLC Terms & Conditions

These Terms and Conditions (“Agreement”) apply to Oakhaven Collective, LLC, also doing business as Oakhaven Company (hereinafter, “Oakhaven Collective,” “Oakhaven Company,” “We,” “Us,” “Our”). By opting into or participating in any of our mobile messaging programs (the “Program”), you accept and agree to these Terms and Conditions, including, without limitation, your agreement to resolve disputes with us through binding, individual-only arbitration, as detailed in the “Dispute Resolution” section below.

Overview

By participating in our Program, you represent that you do so with a genuine intent to receive offers, promotions, updates, and communications from Us—not for the purpose of initiating litigation or asserting claims. If you are participating for any reason other than legitimate interest, you must immediately unsubscribe and agree to indemnify Us for any expenses, including attorneys’ fees, resulting from misuse.

This Agreement governs only the Program and does not replace or modify any other Terms and Conditions, Privacy Policy, or agreements applicable to your use of our products, website, or services.

User Opt-in

By opting into the Program, you consent to receive recurring automated marketing and informational text messages (e.g., SMS, MMS, RCS) from Oakhaven Collective. These may be sent via autodialer to the mobile telephone number you provided. Consent is not a condition of purchase. Message frequency may vary, and message/data rates may apply.

You represent and warrant that you own or are authorized to use the number provided. You agree messages may be delivered at any time, including outside normal business hours.

User Opt-out

You may opt out at any time by replying STOP, END, CANCEL, REVOKE, UNSUBSCRIBE, or QUIT to any message from Us. You may receive one confirmation text. Other unsubscribe methods (such as verbal requests) are not guaranteed to be effective.

By participating, you also agree to our general Terms of Service and Privacy Policy, which govern the use of our website, products, and services.

Program Description

Users who opt into the Program may receive:

•Order confirmations, shipping updates, and customer support messages

Consent to Receipt of Electronic Iinformation and E-sign

 Notwithstanding anything herein to the contrary, you understand that applicable law may require Us to provide certain information to you in writing in connection with any consent to receive advertising and telemarketing messages. By opting-in to Our messaging program, you authorize Us to provide this information to you electronically instead of in a separate paper document. You understand that you may withdraw this consent, update your information, or request a free paper copy of the information by emailing us at support@oakhavencompany.com. You understand that to access and retain a copy of this webpage, you will need: (i) a device (such as a computer or mobile phone) with a web browser and Internet access; and (ii) available storage space on that device to download a copy of this webpage of a connected printer to print a copy of this webpage.

Disclosure of Data to Identify Device and Prevent Fraud

Further, You authorize the use or disclosure of information about your account and your wireless device, if available, by or to your wireless carrier, Oakhaven Collective or Our service provider(s), including Stodge Inc. dba Postscript, to help identify you or your wireless device when you opt-in to receive text messages from any Postscript customer and to endeavor to detect and prevent fraud. Prohibited Content

You agree not to send or transmit prohibited content, including but not limited to:

  • •Fraudulent, defamatory, harassing, or threatening material
  • •Profane, obscene, hateful, or discriminatory content
  • •Malware, viruses, or harmful code
  • •Unlawful promotions, goods, or services
  • •Protected health information (HIPAA-related)

Dispute Resolution & Arbitration

Binding Arbitration: Any dispute, claim, or controversy between You and Oakhaven Collective, arising from or relating to this Agreement, shall be resolved exclusively through binding arbitration conducted on an individual basis, under the Federal Arbitration Act.

No Class Actions: You waive any right to participate in a class, collective, or representative action.

Informal Resolution: Before arbitration, the initiating party must notify the other in writing and attempt good-faith resolution within 60 days.

Arbitration Administration: Unless otherwise agreed, arbitration will be administered by a recognized arbitration provider such as AAA or JAMS, pursuant to their rules.

Small Claims Exception: Either party may bring qualifying claims in small claims court.

Miscellaneous

• Failure to enforce any provision does not constitute waiver.

•If any term is invalid or unenforceable, the remainder remains in effect.

•We may update these Terms at any time, and continued participation constitutes acceptance.
